Terms of service

This agreement is made between Pawz Photo Studio and the person booking the pet photography services.

Scope of Services:The Photographer agrees to provide pet photography services to the Client as outlined in the package selected by the Client.

Vaccination Requirements:The Client agrees to provide proof of current vaccinations for their pet(s) before the photography MINI session. The vaccinations required are as follows:

• Dogs: Rabies, DHLPP (Distemper, Hepatitis, Leptospirosis, Parvovirus, and Parainfluenza)

The Photographer reserves the right to refuse services if the pet(s) do not meet the vaccination requirements. This requirement applies only to Mini Sessions, as multiple dogs may use the set and, due to time constraints, the area cannot be fully disinfected between sessions. For private regular sessions, is ok if the pet is not fully vaccinated.

Session Details:The date, time, and location of the photography session will be agreed upon by both the Photographer and the Client. The session will last for the duration specified in the package selected by the Client.

Payment:The Client agrees to pay the Photographer the full amount specified in the package selected by the Client. Payment is due on the day of booking the photography session. The Photographer reserves the right to withhold delivery of the final images until payment is received in full.

Cancellation and No-Show Policy

The Client may cancel or reschedule a photography session by providing written notice to the Photographer at least 48 hours before the scheduled session.

Cancellations or rescheduling requests made less than 48 hours before the scheduled session will result in a 50% cancellation fee based on the total package price.

If the Client fails to attend the scheduled session without providing prior notice (no-show), 100% of the session payment will be forfeited and is non-refundable. A new session will require a new booking and payment.

Pet Behavior & Session Results

The Client acknowledges that animals are unpredictable and that their behavior, temperament, comfort level, attention span, and willingness to cooperate may affect the photography session and final results. The Photographer will make reasonable efforts to obtain the best possible images; however, specific poses, expressions, compositions, or a specific number of usable images cannot be guaranteed.

Image Rights:The Photographer retains the right to use any images from the session for their portfolio, website, social media, marketing, or other promotional purposes. The Client is prohibited from selling or otherwise profiting from the images without the Photographer's written permission. The client has full rights of images for personal use only.

RAW & Unedited Images

Pawz Photo Studio does not provide RAW, unedited, unfinished, rejected, or otherwise incomplete image files. The Photographer retains sole discretion over the selection of images presented and delivered to the Client.

The Client acknowledges that professional editing and post-production are an integral part of Pawz Photo Studio’s photography and artistic style. Only final, professionally edited images selected and approved by the Photographer will be delivered.

Image Editing, Modification & Usage

All photographs created by Pawz Photo Studio remain the copyrighted intellectual property of the Photographer. Unless otherwise agreed to in writing, the Client receives a personal-use license to the final delivered images.

The Client may not alter, edit, retouch, manipulate, crop in a manner that materially changes the image, apply filters or presets, remove watermarks or branding, replace or modify backgrounds, use artificial intelligence (AI) to alter or generate variations of the images, or otherwise modify the Photographer’s work without prior written permission.

Images may not be sold, licensed, submitted to third parties for commercial use, used in advertising, marketing, product packaging, promotional materials, business websites, paid social media campaigns, or otherwise used for commercial purposes without prior written permission and, when applicable, a separate commercial license from Pawz Photo Studio.

Personal sharing on the Client’s personal social media accounts is permitted, provided the photographs are not materially altered or used to advertise or promote a business, product, or service.

Force Majeure:The Photographer will not be liable for any failure or delay in performing their obligations under this agreement if such failure or delay is due to circumstances beyond their reasonable control, including but not limited to acts of God, government restrictions, wars, riots, or other unforeseeable events.

Liability:The Photographer is not responsible for any injury, or damage to property that may occur during the photography session. The Client is solely responsible for their pet(s) and any damage caused by them to any property or humans.

The client acknowledges that participation is voluntary and assumes all responsibility for their dog’s health and well-being. The photographer shall not be held liable for any illness, injury, allergic reaction, or medical condition that may occur before, during, or after the session. If your pet has a history of seizures, please consult your veterinarian prior to booking a session. While flash photography has not been proven to trigger seizure episodes, caution should be exercised.

 

This agreement contains the entire understanding of the parties and supersedes all prior negotiations, understandings, and agreements between them.
